Privacy Policy

1. Introduction

AhaLearning Inc. is a 501(c)(3) nonprofit organization recognized by the Internal Revenue Service. All donations are tax-deductible to the extent permitted by law. AhaLearning Inc. is a (refer to "we", "us" or "our") providing online educational resources for students, parents, teachers and other site visitors (together “Users”) to learn and connect. The website, applications, and associated services provided by the Nonprofit organization are collectively referred to as the “Services.” We are committed to protecting the privacy of individuals who use our Services and others with whom we interact.

Please take a moment to read this policy so you understand how we collect, process, use, dispose and protect information that relates to an identified or identifiable individual across our Services ("Personal Information"). If you can't be identified (for example, when Personal Information is aggregated and anonymized) then the information or data is not Personal Information and this notice doesn't apply.

2. This is a Legal Agreement

2.1 Acceptance of Terms

When a User uses the Services in any manner or fashion, whether through a purchase or trial period, a site visit, by downloading the Nonprofit organization’s software, or through a teaching, parent or guardian relationship, the User hereby agrees to these Terms.

2.2 A User may not agree to these Terms if the User is not legally allowed to, or if the User is under 18 years old. Users under the age of 18 (“Minor Users”) require a parent or legal guardian (a “Guardian”) to allow them to use the Services and to agree to these Terms. By permitting a Minor User to use the Services, the Guardian of the Minor User becomes subject to these Terms and agrees to be responsible for the Minor Userʼs activities on the Services. If User (or a Minor Userʼs Guardian, as may be applicable) doesnʼt agree to these Terms, the User may not use the Services.

3. How we collect your personal information 

When you visit or use our Services, we collect Personal Information mainly through the following methods:

3.1 Information you provide to us directly

When you visit or use some parts of our Services, we may ask you to provide Personal Information to us.

3.1.1 Registration Data: We collect your name, email, phone number, and other details during registration. We may also request your child’s age, gender, and Chinese proficiency level.

3.1.2 Activity Data: We collect content you or your child submit via our website or app—such as messages, comments, class interactions, assignments, instructor feedback, and course history—to deliver and personalize Services.

3.1.3 Payment Information: To process purchases, you may need to provide billing details. We do not access or store credit card information.

3.1.4 Customer Support: If you contact us, we may collect all information you provide. For users under 13, we may respond once and delete the information.

3.1.5 Messages: We may collect information shared through messaging features, including SMS (standard rates apply).

3.1.6 Surveys: Participation in surveys may involve sharing contact or personal information.

3.1.7 Trial Class: To schedule a free trial, we collect contact details such as your email and phone number.

3.2 Information We Collect Through Use of the Services

3.2.1 Recordings: We may record lessons for review and quality assurance. You can disable this feature in your privacy settings.

3.2.2 Device Data: We automatically collect device information such as model, OS version, identifiers (e.g., Android ID, IDFA), IP address, and network status when you use our app.

3.2.3 Usage Data: We track how you navigate the Services—pages viewed, links clicked—to help improve user experience.

3.2.4 Third-Party Providers: We may collect data from service partners strictly to support our contractual obligations.

3.2.5 Cookies: We use cookies and similar technologies to enhance functionality. You can manage cookie settings in your browser, though doing so may affect Service performance.

4. How We Use Your Personal Information

4.1 To deliver the Services you or your child request and manage our relationship with you.
4.2 To provide requested information, such as educational content or advisor access, and any legally required communications.
4.3 To inform you of service updates or provide usage assistance.
4.4 To send marketing communications based on your preferences.
4.5 To request feedback or invite participation in user research (which may involve third parties).
4.6 You may opt out of marketing emails by clicking “unsubscribe” in any such message.
4.7 To provide technical support and enhance the Services through user interactions.
4.8 To monitor usage and perform technical analysis to improve user experience.
4.9 To detect and prevent fraud, abuse, or violations of our terms.

5.1 We do not sell your Personal Information. We only share it with third parties for limited, necessary purposes as outlined below.

6.2 Access to our Services is protected by user-generated passwords. Users are responsible for maintaining the confidentiality of their credentials.

Users should not share their passwords. AhaLearning is not responsible for any data loss or privacy breach resulting from shared or compromised account credentials.

7. Retention and Deletion of Personal Information

We retain your Personal Information until the earlier of:

7.1 receiving your request for deletion; or

7.2 determining that retention is no longer required to meet legal obligations or prevent harm.

8. California Privacy Disclosures

This section applies to California residents and outlines the personal information AhaLearning collects, along with the rights granted under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA).

8.1 Categories and Use of Personal Information

See the “How We Collect Your Personal Information” and “How We Use Your Personal Information” sections for details on what we collect, sources of that information, and how it’s used.

8.2 Your Rights Under CCPA and CPRA

8.2.1 Right to Access and Data Portability

You may request details on the categories and specific personal information we collect, sources, purposes, and third-party disclosures.

8.2.2 Right to Delete

You may request deletion of your personal information. If immediate deletion is not possible, we will securely store and isolate it until deletion can be completed.

8.2.3 Right to Opt Out of Sale or Sharing

We do not knowingly sell your personal information. However, some tracking technologies may be considered a “sale” or “sharing” under California law. To opt out, contact us at info@ahalearninginc.org.

8.3 Sensitive Information

We do not use or disclose sensitive personal information in ways that would require offering a right to limit under California law.

8.4 Non-Discrimination

We will not discriminate against you for exercising your CCPA/CPRA rights.

8.5 “Shine the Light”

Under California Civil Code § 1798.83, you may request information regarding our disclosure of personal data to third parties for their direct marketing.

8.6 Exercising Your Rights

You may exercise your privacy rights directly or through an authorized agent by contacting info@ahalearninginc.org. We will respond within one month. Please refer to the relevant sections in this policy for details on data collection, usage, and sharing.

8.7 Do Not Track (DNT)

AhaLearning does not track users across third-party websites and does not respond to DNT signals.

8.8 Notice of Financial Incentives

We may offer discounts, promotions, or referral rewards that could be considered financial incentives under California law. You may withdraw at any time by contacting info@ahalearninginc.org.

9. Your Child’s Privacy

9.1 Protecting children’s privacy is a priority. We define “children” as anyone under 13 outside Europe or under 16 in Europe. We require verifiable parental or guardian consent before collecting a child’s personal information. Consent may be withdrawn at any time.

9.2 To deliver our Services, we collect limited personal information from your child and apply appropriate safeguards to ensure its confidentiality and security.

9.3 When scheduling a free trial, we may collect your child’s age to match the appropriate class. Children may not create accounts directly; a parent or guardian must register. During registration, we collect basic child information and your contact details. We may also assess your child’s academic level and collect submitted course content, including assignments, instructor feedback, and optional details. Required and optional fields will be clearly indicated.

9.4 We collect activity data such as class questions, responses, and comments, along with your child’s video, voice, and image to support class playback and quality assurance.

9.5 Before your child accesses our platform, we require parental login and basic child information (e.g., nickname, age, language level). Verifiable consent is requested via email. We do not knowingly collect personal information from children without consent. If such data is collected inadvertently, we will delete it promptly. If your child registers without your permission, please contact us to request deletion.

9.6 We use cookies and similar technologies to collect usage data from you and your child. This data is not linked to personally identifiable information such as your email. You may manage cookie preferences in your browser, though doing so may affect Service functionality.

9.7 We use your child’s personal information to

9.7.1 Match appropriate trial classes

9.7.2 Manage account preferences and user profiles

9.7.3 Track course progress

9.7.4 Communicate with you and instructors

9.7.5 Support service delivery through third parties

9.7.6 Address support inquiries and resolve disputes

9.8 We do not sell or use children’s information for marketing. We may share it only as follows:

9.8.1 With affiliates and subsidiaries

9.8.2 With trusted service providers (e.g., virtual classrooms, data storage)

9.8.3 As required by law or legal proceedings

9.8.4 To protect the rights, safety, or property of AhaLearning or others

9.8.5 To law enforcement for public safety matters

9.8.6 In aggregated, non-identifiable form for reporting or analysis

9.9 We respect your rights to access and correct your Child's Personal Information. You may review your child's Personal Information we collected, request for rectification or deletion of your child's Personal Information, or restrict the further collection or processing of yours Personal Information at any time.
